Sapient rights, including the right to dignity, are the foundation of the ship's rights and laws. All sapients, including artificial intelligences, are considered equal before the law and have equal rights.
Personal freedom is guaranteed; these freedoms include:
- Freedom of religion and religious practice
- Freedom to do as one pleases as long as it does not infringe on the rights of others
- Freedom to life and reasonable protection from physical harm
- Freedom to opt out of rendering military service to Command or the Council
- Freedom of speech and expression
- Freedom of press/freedom from censorship
- Freedom of teaching, as long as it is in line with the constitution
- Freedom to assemble unarmed or form coalitions
- Freedom to pursue artistic and scholarly pursuits
- Freedom from forced labor unless under court order
- Freedom to choose their occupation
- Right to privacy in telecommunications from government interference unless otherwise mandated
- Freedom to a single vote in council elections
These right, except for the right to vote, may be limited for young crew members. Outdoor assemblies may be restricted for public safety reasons. Civilian organizations whose aims or activities breach established law or are deemed hostile are prohibited.
Sapients may not be discriminated against by the governing bodies based on sex, parentage, race, species, abilities, language, homeland or origin, faith, sexual orientation, or religious or political opinions.
The Council reserves the right to consider these basic rights forfeit if the individual in question has been charged and/or convicted of a crime.
Civilian Council
The Council is an elected body of 5 members responsible for civilian legislation and management. Elections will be decided by majority vote and ties will result in run-off elections until a winner is determined. Nominees must be self-nominated. Council members may not simultaneously serve in a command position or as a department head. The duration of a council term is four years as estimated by the crew at large. Councilors may be recalled and replaced by petition and public majority.
Councilors must introduce laws by bill; Council majority can approve the law. The Captain must approve it for it to be enacted - if not, Council may override the veto with a 4/5ths majority. A 60% majority from a crew vote can repeal/overturn any law.
The Council may create departments for the ship, but the Captain must approve each one.
Voter fraud will be penalized by permanent disallowance from serving in a department head, Command staff or Council position, as well as a brig sentence of up to 180 days.
Command Staff
Command Staff is responsible for overseeing and regulating all military functions of the ship and for maintaining crew safety and ship function. Captain and First Officer are elected by the crew and serve for a six-year term. The Captain or First Officer may be removed by a 4/5ths vote from the Council of No Confidence if petitioned by the crew. Removed officers may run for re-election at a later date and will be immune from a No Confidence vote for the first year, should they win.
The Captain reserves the right to deem information or ship locations classified and to seize non-essential resources as military property. The Council may overturn any of these with a 4/5ths majority.
The Captain is responsible for laying out operational rules and regulations for the following departments: Command, Training, Tactical, Engineering, Neuropathy, and Rogue Squadron. The Captain is responsible for laying out rules and guidelines for away teams and away missions.
Lt. Commanders, Lieutenants, and Department Heads are appointed by the Captain but must be confirmed by a Council majority upon initial appointment.
The Captain or highest ranking officer may declare a State of Emergency if there is clear, present, imminent and immediate danger to the crew, which enacts a temporary state of Martial Law. The highest ranking Command officer may direct and person or resource as they see fit until the State of Emergency is ended. Failure to obey may be penalized by extensive time in the brig. The Council may override the State of Emergency with a 4/5ths majority.
The Captain may create new departments but they must be confirmed by a 3/5ths Council majority. Only the captain may depose appointed officers unless they have been charged with a criminal act. If a new Captain is voted in, all appointed officers still retain their position, unless removed by the new Captain.
Joint Departments
The Command Staff and the Council are jointly responsible for laying down the rules and appointing heads of the following departments: Security, Science, Medical, and Mystical
Removal of a department head requires either a 4/5ths vote of the Council, the Captain and First officer to jointly order the department head removed, or a 3/5ths Council majority with the Captain agreeing to remove them.
Security/Away Teams/The Crew
No member of the crew may be arrested, charged with, tried for, and imprisoned for any crime they committed on their homeworld prior to joining the crew, regardless as to whether or not the crime was committed against current crew members.
On ship, at all times, beginning at their initial entrance to the observation deck, all members of the crew are subject to all laws made by the Council. These laws will be enforced by ship Security. Off-ship, the crew is subject to the laws of the local populace, if any, as well as the rules and regulations set forth by the Captain.
Security reserves the right to administer penalties for minor infractions without trial. Crew members may petition the Council is they want a trial or think they were unfairly punished.
Any member of Security, Council or Command charged with a crime will be removed from their position during investigation.
Security are the only ones authorized to conduct criminal investigations. Departments are authorized to handle non-criminal investigations within their departments. Security solely reserves the right to issue a warrant if directed by the Captain or a 3/5ths majority Council.
Trials will be by a jury of six peers with an impartial member of council presiding, unless the accused chooses to waive the right to a jury.
Court martial will be before a tribunal of three senior officers.
Property Rights/Bunks/Weapons & Possessions
All religious buildings and parks are considered communal property. Anyone may use them freely. All office spaces and residencies may be claimed on a first come, first serve basis. One may only claim one residence and one place of business.
Each crew member is entitled to one bunk and one Possessions locker.
Unclaimed arms and vehicles are property of Command.
